How a Personal Injury Lawyer Can Help You with Your Claim

If you have been involved in an accident or injured at work, it may be that one of the first things that comes to mind is compensation. Although it has its benefits, it is not as straightforward as you may have imagined should you choose to fight your own battle.

One of the first things to do is to approach an insurance company. This may be your own insurance company or that of whomever you deem responsible for the accident. Typically, this would be hassle free as this is the very reason why insurance companies exist.

However, any personal injury lawyer will say that it is not always as easy as it should be. One of the reasons if that the sheer volume of paperwork needed for the compensation to go through is on the same level of bureaucracy as a government office. This results in delays in receiving your compensation. At the very worst, technicalities can result in your  claim being turned down, such as if you don’t file something you should have done or enter incorrect information in a form. Another issue with insurance is that you may not get the full amount required.

Another option is that the third party will offer you a settlement. Some choose to accept this offer without question if they are under the impression that a court case will prove more costly and take up a lot of time. It may not be your best option, however, which is where your personal injury lawyer comes into play.

Going to court usually accomplishes the highest amount of compensation. This is the best option, certainly if you have a high chance of winning and you have a decent lawyer working in your corner. Further, many personal injury lawyers operate on a no-win, no-fee basis so any concerns over escalating court costs can be alleviated before even setting foot in the courtroom.

Roger Bolt and Lynn Burdon at BBK have been dealing with cases for 25 years and have built a huge amount of knowledge, skill and experience which is why we have earned such a string reputation.

We operate under no win, no fee so you won’t need to pay any upfront fees. However, we have been winning cases for a long time and enjoy a tremendous success rate, guaranteeing compensation in full.

So give is a call today and let’s set the ball rolling in your claim for compensation. We are on hand to talk over other issues you may have such as the interest rate swap scam.

The Importance of Filing Accident Claims

There are a large number of people involved in accidents each and every day. Unfortunately, many of these people do not fully understand how important filing accident claims is when this happens. Even worse than this is the fact that a large number of these people also don’t realize why filing such claims is so important. This is why it is highly recommended that you seek consultation of some type any time that you are involved in an accident. This is true even if the accident seems small and inconsequential because not all problems resulting from an accident will be evident right away. In some cases, particularly with injuries, it may take hours or even days for symptoms to manifest.

Filing accident claims is important because failing to do so means that you will almost certainly not be compensated for any damage or injury that results from the accident in question. This means quite simply that if you are injured and you do not file a claim then you will be responsible for any cost associated with your injury. This can really become disastrous when an injury is severe enough to cause you to miss time from work.

Accident claims were designed to help deal with a variety of issues that can and often do arise from an accident. Some common problems that generally manifest as a result of an accident often include the following occurrences:

  • Personal Injury
  • Property Damage
  • Loss of Wages
  • Temporary Disability
  • Permanent Disability

While some problems stemming from an accident may be minor there are other times when the end result is much more serious. It is for this reason that a claim should be filed even if the accident seems to be a small one.

It is not difficult to see why filing accident claims are important and how very beneficial such claims can be. If you are involved in an accident it is very important that you file a claim in a timely manner. The reason for this is that there are limits to how much time that you have to receive compensation for damages or injuries which result from an accident. The sooner you begin this process the better the chances that your claim will end in satisfactory results. Remember, it is up to you to get the ball rolling as quickly as possible following an accident.

Two Dangers to Identify and Solve in Your Relationship

  1.  Communication Breakdown

Don’t confuse a communication breakdown with ‘talking less’. As your relationship develops with your loved one, it is very normal for couples to actually have less to talk about. This isn’t necessarily a bad thing – in fact, talking less is often associated with feeling more and more comfortable with your partner. The need to impress by making conversation or cracking funny jokes eventually dries up, and you can simply enjoy each other’s company in quiet.

A communication breakdown also isn’t when your partner forgets to pick up dinner even though you thought you told them to, or they pick up fish when you’d specifically texted asking for chicken. That is simply a question of being clearer!

A communication breakdown is widely defined as a ‘failing to address problems’. If you are going through your relationship pretending everything is alright when really it isn’t then this is when problems arise.

EXAMPLE: Your partner (let’s say boyfriend) often has to work late with his work. Often after a particularly late shift, his boss will treat the team to some drinks at a nearby bar to wind down. However, you hate it when this happens because it means that your boyfriend will be spending time at the bar with a girl in his team that you have always had your suspicions about (whether justified or not). You don’t want to say anything about it to him for risk of sounding insecure and needy, so you just spend the evening worrying. When he returns he finds you in a bad mood, you are too embarrassed and ashamed to say why, but you JUST can’t shift the mood. The night carries on awkwardly with him knowing something is bothering you but you being too afraid to speak up about your concerns. You hate yourself for it and he wonders what he has done wrong. THIS is a communication breakdown.

Learn to realise when this sort of thing is happening, and have the courage to see that your insecurities (however niggly and embarrassing) and subsequent refusal to talk about them could be leading your relationship down a long and slippery slope. Getting a problem out in the open early is always much better than letting it grow inside you.

SOLUTION: Let’s use the example above. Address your concerns head on, with him. If the thought of directly quizzing him about another girl fills you with dread, then you can still approach the matter in a more subtle way. When he calls you to say he’ll be home late because he will be at the bar, why not ask if you’re invited? He may so no, and blame it on the fact he wants to let off steam with his colleagues (fair enough), but if he keeps on refusing on subsequent occasions, you may then have more reason to believe that actually he doesn’t want you there because he wants alone time with a girl. And if he is, then it’s time to get out of there anyway

2. Loss of intimacy

This is one of the most feared side-effects of a relationship. The early days, weeks, and months of relationships are sparked on by the thrill of being physically close to your partner. Falling in love is a blur of kisses, cuddles, holding hands and making love that feels as if it will last forever. We all know it doesn’t.

So by ‘loss of intimacy’ we are not referring to the fact that he might not always have his arm around you anymore, and isn’t trying to kiss your neck at every opportunity; we are referring to a loss of intimacy that simply isn’t acceptable in any relationship, no matter how long the couple have been together.

If weeks fly by in a series of excuses for reasons not to make love, and he hesitates to kiss you out and about (even if he is a non-‘PDA’ (public display of affection) kind of guy), then you should really take a step back and look at what is going wrong.

It is naïve to think that every relationship is full of passion all the time – in fact factors such as stress and work commitments can genuinely hamper an appetite for intimacy even if the relationship itself is in good health. But these situations can be dealt with as a couple and more often than not successfully navigated.

But intimacy IS an incredibly important factor of any relationship. Our brains are hard-wired through evolution to enjoy touching and making love, so it cannot be ignored. If you and your partner are going extended periods of time with no intimacy then it might be time to look at your relationship as a whole.

SOLUTION: It is dangerous to assume that just because you haven’t been intimate for a long period of time that the relationship is doomed. There can be a whole number of reasons why he may be hesitant to get intimate despite all other aspects of the relationship being in good health. So don’t panic. More often than not the reason will be his own, not anything to do with you. So don’t go on a mad weight-loss diet or have all your body hair waxedoff as a knee-jerk reaction just because you fear that might be the reason! He may be having embarrassing problems ‘down below’ that he is too scared to address with either you or a doctor for example. Do your best to get information like this out of him.

Bring negligent employers to account over personal injury

Employers have both a legal and moral duty to protect staff at work. They must comply with health and safety regulations in order to provide every member of staff with a safe working environment. Accidents do happen from time to time. A zero harm workplace is an almost impossible undertaking, but when it’s not the employee’s fault they have every right to pursue a personal injury claim.

Without adequate training or supervision accidents are bound to happen. Or if risk assessments aren’t carried out and acted upon things will go wrong. Rules and regulations are there for a reason. Every responsible employer knows their responsibilities. If they fail to fulfil them and someone gets hurt then they are very much in the wrong.

Bringing a personal injury claim can be complicated. Taking on a large corporation without legal support and representation is a huge undertaking, which is why people usually look to a personal injury claim solicitor to help them make their case. These specialist lawyers are experts in this area of the law. They know how to make a case successfully and a powerful ally in seeking justice.

Accidents can have a huge impact on people’s lives. They can leave workers traumatised, in severe pain and sometimes with permanent disabilities. A cash pay out won’t make up for all of this, but it is at least a form of justice. Just like any other kind of legal professional a personal injury claim solicitor is a skilled professional who commands large fees. However, most are prepared to work on a no win no fee basis. This removes financial risk from the equation. An unsuccessful case won’t leave the individual concerned with a huge legal bill. No win no fee is helping ordinary people get access to the legal help they need to bring negligent employers to account.

Abortion Becomes a Hot Topic in the UK

A controversy has erupted in the UK over the pre-signing of abortion consent forms. A woman in the UK is required to get the signature of two doctors on a form before she will be admitted for an abortion procedure.

It was revealed at one clinic in Birmingham that a doctor had pre-signed a batch of forms in anticipating of women wanting an abortion. It was then thought that the pre-signed forms would enable one doctor to make an individual decision regarding whether or not to allow the abortion.

Some argue that pre-signing was undertaken in order to reduce the distress caused to women who were carrying an unwanted pregnancy. Labour MP Diane Abbott accused Andrew Lansley of launching a war against Doctor’s professional expertise and crucially, women’s right to choose and access abortion.

The British Pregnancy Advisory Service were the primary critics in the matter, saying that the issue of pre-signing was not one that required legal intervention against doctors, but simply an issue which may require regulation. Crucially, it does not mean a reduction in care being given to women seeking an abortion. Pro-choice activists continue to argue that one signature should be all that’s needed.

It is thought that the fresh controversy over abortion services in the UK will result in fewer young medics wanting to specialise in terminations. There are in fact very few people with the skills to perform surgical terminations after 12 and 14 weeks of pregnancy. Most terminations are carried out before 13 weeks of pregnancy (91% according to statistics) and are carried out in special clinics.

A commission later reported that it had not found evidence of medical malpractice or poor care at any of the 14 clinics that it investigated. It also complained that health minister Andrew Lansley’s plans had wasted £1 million of public money in an era where cuts are being planned everywhere from GP surgeries to money paid out by the NHS in medical negligence claims.

A parallel controversy has also arisen over charity groups which are invited to speak in schools on the subject of abortion. There have been reports that these groups have been telling children that abortion leads to an increased risk of breast cancer. The children were also told that rape victims who had gone through with their pregnancies were able to take away “something positive from the experience.” Other activists have gone on record to say that they are concerned about anti-abortion groups  accessing schools in the UK and spreading information that is medically incorrect.

London has also recently seen protests outside of abortion clinics – a rare sight in the UK up until recent months. The group 40 Days For Life has come under criticism for harassing and photographing women outside abortion clinics and there was also the unconnected case of the independent hacker who “disagreed” with abortion and illegally obtained the medical information of several women in order to disrupt BPAS’s website services.
